Fraud is a Difficult Matter to Discuss

Eye on Election's forum on Tabulator Fraud got cancelled amid threats of lawsuits and charges of spreading "misinformation". But we won't be silenced. We have made a video, and in this article discuss whether Eye on Elections can really be sued for slander.

The Eyes on Election public event scheduled for June 14th focusing on Tabulator Fraud in Idaho was cancelled by Watchman Ministries because of legal risks associated with "spreading disinformation."

It is somewhat IRONIC, however, that the talk was cancelled, given that its main focus was on the reluctance of Idaho's political establishment to face up to credible evidence of MACHINE FRAUD. The second half Eye on Tabulators video, directly addresses how difficult it is to get anyone in a position of political authority to acknowledge the possibility of machine fraud or to allow an open discussion of the topic.

Instead, compelling evidence proving fraud is ignored, dismissed, or misrepresented to promote a pro-tabulator narrative because the corruptability of electronic tabulators is not something that any influential person in Idaho politics wants to discuss.

The truth is, tabulators can be hacked, and there is abundant evidence that they HAVE been hacked in Idaho. Eye on Elections believes people should know about this and we won't be silenced.

Liberty Without Compromise

Fortunately, not everyone fears Election Fraud controversy. On June 11th, the featured speaker at the cancelled Tabulator Fraud forum was a guest on the Liberty Without Compromise show, and we had a fascinating conversation about many topics related to Machine Fraud (discussion starts at 48:40). It is well worth watching.

Better yet, hosts Dan and Dawna Wilson have invited us back, to continue the discussion. Eye on Elections will be reappearing on the Liberty Without Compromise show in July.

The Cancellation Explained

The original reason that Watchmen Ministry gave for cancelling the event was that they were warned that if they hosted an event discussing accusations of election fraud, they could be sued for slander. When they consulted their lawyer, he confirmed that this was a possibility and recommend the event be canceled. Since election fraud is a contentious issue, and people have been sued for making claims of fraud, it is not at all suprising that their lawyer, would make this recommendation.

We regret this turn of events, but we respect the work of Watchmen Ministry, and did not intend to create trouble. We understood why they decided to pull out, and at first decided to go ahead with the program without their involvement. But when Watchmen Ministry told us it would them in a difficult position if we continued, we agreed to cancel.

We thought this would be the end of the matter, but now Watchman Ministry has posted its own version of events claiming that they reviewed our presentation and were "unable to verify" Eye on Elections claims of fraud. We're glad they posted this to let people know their viewpoint, but they appear to have completely mis-interpreted the data and misrepresented Eye on Elections claims.

We understand that when only a few people vote early, the sample size is inconclusive, and Eye on Elections has NEVER claimed that Election Day voting ALWAYS tracks Early Voting. But in the November 2024 election, over 19 thousand, or 25% of in-person voters voted early. This is an ENORMOUS sample size, and it should correlate much better with election day voting than 9%. We explained the probabilities behind our claims over six months ago in the Statistical Proof Video above (8:02), and have been over this ground before. (15:30)

Electronic Election Fraud is very sophisticated, and it can be difficult for people who are unfamiliar with the issue to understand what is really going on. This is not the first time Eye on Elections has been misquoted or misrepresented and it won't be the last.

We will rebut Watchman ministries misrepresentation of our evidence at a later time, but one of the main points of their critique is the fact that there has not always been a close correlation between Early and Election day voting in past elections. But this is because in past elections early voting has only been a small percentage of in-person voting.

Eye on Elections CAN'T be Sued for Slander

The reason Eye on Elections is not afraid of being sued for slander is that exposing Election Fraud in Idaho is that when we educate the public on the topic of election fraud, we are careful to state only proven facts or opinions that are based on solid evidence.

In short, we have evidence for all of our statements, and in the case of slander the burden of proof is on the plaintiff to prove that anything we claim is false. That is, in order to sue us for “falsely” claiming that the NIC Trustee Elections were stolen by machine fraud, whoever sued us would have to PROVE that the election was not rigged, which they cannot possibly do.

The reasons that it is impossible to PROVE that an electronic tabulator was not rigged for a particular election are all laid out in NISGR's series on tabulator fraud in Kootenai County.

If it was possible to prove that electronic tabulators could not be programmed to cheat, then we would have no objection to them, and would not have spent the last six months developing constructive solutions to deal with the problem.

But it is impossible to prove whether or not an election was rigged without doing a full manual recount (or at least independently photocopying all ballots) immediately after the polls are closed, and before any ballots can possibly be switched out. And this is the precise problem that Eye on Elections is committed to help solve.

The threat of slander, does of course, explain some of the bizarre text messages we get from people who would LOVE to see us make unsupported allegations against certain people, so that we could be sued.

There is one other reason that the researchers behind Eye on Elections are certain they cannot be sued for slander. Even if someone could prove that our accusations of fraud are unfounded—which is impossible—there is yet one other bar. In order to sue someone for slander, you must prove malice. And there is absolutely no basis whatsoever to believe that Eye on Elections' members have acted with malice, in any way.

In fact, there is abundant evidence that we have involved ourselves with the issue of election fraud with great caution and only out of concern for our country and for future generations. The letter shown below was the first communication with political leaders in Kootenai county, informing them of the fraud discovered in the NIC Trustee election.

From the very beginning, we have understood the seriousness of the accusations of election fraud and proceeded with the utmost care. Election fraud is a tremendous problem that strikes at the heart of the legitimacy of our government, but it was not created by the people who point out that it exists.

On the contrary, it was created by highly sophisticated technocrats, at the behest of powerful power brokers, and it is perpetuated by people who deny it, make excuses for it, and ignore overwhelming evidence that Election machine fraud is problem here in Idaho.

Absence of Malice
